1. Acceptance and eligibility
These Terms of Use (“Terms”) are an agreement between you and Onyx Marketing LLC (“Onyx,” “we,” “us,” or “our”) governing your access to and use of Inherited Home Path at inheritedhomepath.com, its content, forms, and related communications (the “Site”). By using the Site, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Site.
You must be at least 18 years old and able to enter a binding agreement to use a property inquiry form. You may browse the educational resources without being an owner or representative.
2. Site purpose and commercial role
The Site provides general inherited-property education and accepts property inquiries from all 50 states and Washington, D.C. Nationwide inquiry intake does not guarantee that Onyx or another party will make an offer, provide a particular transaction structure, or be able to proceed under the law and facts that apply to a property. Onyx Marketing LLC or a disclosed purchasing party may evaluate the property for its own benefit, not as your broker or agent. Any offer may be below market value. You may obtain an independent valuation and legal advice before signing. The written agreement and any disclosures required by applicable law control.
Onyx is not a law firm, CPA firm, title company, closing agent, court, government agency, fiduciary, or your real-estate broker merely because you use the Site. Nothing on the Site creates an attorney-client, accountant-client, fiduciary, brokerage, agency, partnership, joint-venture, or confidential advisory relationship.
4. Offers, estimates, and transactions
Site content, calculators, examples, discussions, and property reviews are not appraisals, broker price opinions, title commitments, tax calculations, credit decisions, or binding offers. Any actual offer is subject to property, market, title, authority, occupancy, inspection, funding, and written contract terms.
A direct as-is offer may be materially lower than what a prepared home could sell for after market exposure. Compare the written net, work, timing, and risk. You may seek an independent appraisal, agent opinion, attorney, tax professional, title review, inspection, or other advice.
No closing date, title solution, court result, tax outcome, net proceeds, cost allocation, repair waiver, cleanout arrangement, funding, or offer is guaranteed by general Site language. Oral statements do not amend a signed contract. If a convenience or condition matters, including belongings, occupants, moving, costs, title work, or timing, include it in the written agreement.
You should independently verify the legal name of the buyer, proof or source of funds, closing professional, earnest-money holder, inspection and cancellation rights, cost allocations, title process, and wire instructions. Never send money or sign a deed based only on an unexpected email or text.
5. Calls, texts, and electronic communications
The offer form requires a phone number and displays this disclosure beside the final submit control: “you consent to InheritedHomePath.com calling or texting you about this property at the number provided. Consent is not a condition of receiving or accepting an offer. Message and data rates may apply. Reply STOP to opt out.” Submitting requests property-related calls or texts under that disclosure. Message frequency varies. Reply STOP to an applicable text to opt out or HELP for help, or revoke permission by any reasonable method.
To ask about a property offer without requesting phone or text contact, email hello(at)inheritedhomepath.com and state that you want email-only contact. Do not send sensitive estate, identity, financial, tax, or account information through ordinary email.
You agree that electronic records and signatures may be used where law permits. A form submission is not an electronic signature on a purchase contract. Transaction documents may require separate signatures, notarization, originals, witnesses, court approval, or other formalities.
6. Acceptable use and intellectual property
You may use the Site for personal, lawful, informational, and property-inquiry purposes. You may not interfere with security or operation; submit malicious code; scrape or harvest personal information; impersonate another person; submit a property to harass an owner or occupant; make false authority claims; use automated systems to overload the Site; copy substantial Site content to create a competing or deceptive service; or use the Site in violation of law.
The Site design, original text, graphics, organization, and software are owned by or licensed to Onyx and protected by applicable law. We grant you a limited, revocable, nonexclusive right to access and use the Site for its intended purpose. Government and third-party sources remain subject to their own rights and terms.
7. Third-party links and services
The Site links to government, tax, legal-information, consumer, and other third-party resources for convenience. We do not control their availability, accuracy, security, or privacy practices. A link is not an endorsement, professional referral, or guarantee that the source applies to your situation. Independent purchasers, title companies, attorneys, tax professionals, inspectors, contractors, and other providers are responsible for their own services and agreements.
8. Educational and service disclaimers
The Site and its content are provided “as is” and “as available.” To the maximum extent permitted by law, Onyx disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, availability, and results. We do not warrant that the Site will be uninterrupted, error-free, secure, or suitable for a particular estate or transaction.
Probate, inheritance, title, tax, landlord-tenant, disclosure, licensing, contract, recording, and court rules vary. Do not delay a court, creditor, mortgage, tax, insurance, code, utility, occupant, or other deadline while waiting for Site information or a property review.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
9. Limitation of liability and indemnity
To the maximum extent permitted by law, Onyx and its members, managers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or opportunities; loss of data; property damage; or damages arising from reliance on general content, third-party conduct, or unauthorized submissions.
To the maximum extent permitted by law, Onyx’s total liability arising from Site use before a separate written transaction agreement will not exceed one hundred U.S. dollars ($100). A signed transaction agreement may provide different rights and remedies for that transaction. Nothing in these Terms excludes liability that cannot lawfully be excluded.
You agree to indemnify and hold Onyx harmless from third-party claims, losses, and reasonable costs arising from your unlawful Site use, material misrepresentation, infringement, malicious submission, or false claim of authority, except to the extent caused by Onyx’s own unlawful conduct.
10. General terms
These Terms and the Privacy Policy are the entire agreement about general Site use and do not replace a signed purchase, closing, confidentiality, or service agreement. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not transfer Site-use rights without our consent; Onyx may transfer these Terms as part of a business or asset transfer.
These Terms are governed by the laws of Wyoming, without regard to conflict-of-law rules, and disputes concerning the Site shall be brought in a court with jurisdiction in Natrona County, Wyoming, unless applicable law requires a different law or forum.
We may update these Terms by posting a revised version and date. Material changes will receive additional notice where required. Continued use after the effective date means the revised Terms govern later use.
